These General Terms and Conditions (hereinafter GTC) govern Kinoki Limited Liability Company (registered office: Hungary, H-1141 Budapest, Tihamér utca 38-40. Ground floor, Door 6; company reg. no.: 01-09-419826; registry authority: Metropolitan Court of Registration) (hereinafter: Justalayout.com) on the website www.justalayout.com (hereinafter: Service) and the Client (hereinafter: Client), specifying the rights and obligations arising from the legal relationship between them, the conditions for the conclusion of the contract, the rules of liability, the conditions of performance and other contractual terms.
The provisions of these GTC shall always govern the legal relationship established between the Service Provider and the Client.

I. BASIC PROVISIONS
1. For matters not regulated in these GTC, and for the interpretation of these GTC, Hungarian law shall apply, with particular regard to Act V of 2013 on the Civil Code (hereinafter: Civil Code), Act CVIII of 2001 on certain aspects of electronic commerce services and information society services (hereinafter: E-Commerce Act), and Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses. The mandatory provisions of the applicable laws shall be binding on the parties without any specific stipulation.
2. These GTC are effective from 1 March 2026 and shall remain in force until revoked. Justalayout.com is entitled to unilaterally amend the provisions of the GTC. The GTC document and the related amendments are always published by the Service Provider in an accessible manner on its website. By using the Service, the Client accepts that all regulations related to the Service are automatically applicable to them.
3. Justalayout.com declares that the floor plan design and interior architecture service named “Justalayout.com” within its scope of activities is its exclusive property.
4. Justalayout.com does not subject itself to the provisions of any code of conduct.
5. The Client, by accessing the website of the Service provided by Justalayout.com, or reading its content in any way – even if not a registered user of the website, acknowledges the provisions of the GTC as binding upon themselves. If the Client does not accept the conditions, they are not entitled to use the Service or to view the full content of the Service website.
6. The contract concluded electronically between Justalayout.com and the Client under these Terms and Conditions shall be deemed a written agreement and shall be recorded and archived by Justalayout.com in accordance with its internal record-keeping procedures.
By accepting these Terms and Conditions, the Client expressly agrees that Justalayout.com may confirm the conclusion of the contract electronically using the contact details provided by the Client. Accordingly, Justalayout.com is not required to provide the Client with a paper copy of the contract.
The contract formation process and the contract itself are available in English and Hungarian.
II. LEGAL RELATIONSHIP BETWEEN THE PARTIES, SCOPE AND VALIDITY OF THE GTC
1. The personal scope of these GTC extends to Justalayout.com, as well as Justalayout.com and the Client using the Service provided by Justalayout.com.
2. By using the Service through the Service website, the Client enters into a contract with Justalayout.com in accordance with the substantive provisions of these GTC. For the conclusion of the Contract, it is necessary that the Client Justalayout.com reads and accepts the currently effective and valid GTC conditions and the Privacy Notice as binding upon themselves, and consents to data processing. The Service used through the Service website entails a payment obligation for the Client in accordance with the provisions of these GTC. Justalayout.com publishes the current version of the GTC and Privacy Notice for the Client on the Service website.
3. Justalayout.com performs the Service for the Client in its own name, in accordance with the terms applicable to the Service used on the Service website; the Service is completed by the use and performance of the Service and the payment of the consideration due.
III. THE ORDERING PROCESS, FORMATION AND CONTENT OF THE LEGAL RELATIONSHIP
1. The Service can only be used online. Justalayout.com guarantees access to the Service for the Client without registration.
2. The making of the contractual offer by the Client begins with selecting and ordering the Service on the Service website, and sending the data required for using the Service (email, name; address; phone number; delivery method and billing details) to Justalayout.com , sent through the Service website, and by ticking the relevant checkbox. Before finalising the order for the Service, the Client may review the data provided and modify the selected Service, and may then finalise the order for the Service by clicking on the link entitled “Submit Order”. The Client acknowledges that the submission of the order constitutes Justalayout.com's contractual performance.
3. A further condition for ordering the Service is the reading and acceptance of these GTC and the Privacy Notice indicated on the Service website, which are placed in a clearly visible location for the Client before finalising the order. The acceptance of the GTC and the Privacy Notice is acknowledged and accepted by ticking the checkbox next to the link, on the basis of which the Client declares that they have read the GTC and Privacy Statements, understood their content, validly accepts them, expressly consents to the processing of the data provided by the Client, acknowledges the contents of the Privacy Notice, and gives their consent required for data processing.
4. Following the submission of the order, Justalayout.com informs the Client in an automated message about the formation of the order and the contract, and that within 5 business days of the order, Justalayout.com will contact the Client by phone to discuss the details of the Service and further processes. If, following the order placed by the Client, Justalayout.com does not send any automated message or make contact within 5 business days in any form, the Client shall be released from the obligations incumbent upon them under the contract.
5. Justalayout.com is not obliged to verify and examine whether the data provided by the Client is correct, and therefore Justalayout.com is not obliged to verify whether the Client is lawfully in possession of the data provided. The Client accepts no liability for any legal disputes and damages arising in this regard.
6. The Client may request the deletion of data provided during registration at any time by sending a message containing a deletion request to info@justalayout.com. The deletion of data provided by the Client automatically results in Justalayout.com the termination of the contract between Justalayout.com and the Client.
7. Justalayout.com Justalayout.com declares that it refrains from using any content other than personal data generated during the use of Justalayout.com provided by Justalayout.com, or created by the Client, unless such content
- Justalayout.com cannot be used in connection with the digital content supplied or digital service provided by Justalayout.com,
- relates exclusively to the Client's activity carried out during the use of Justalayout.com the digital content or digital service provided by Justalayout.com,
- Justalayout.com has been aggregated with other data by Justalayout.com and cannot be separated, or can only be separated with disproportionate effort, or
- Justalayout.com has been produced jointly with other persons by Justalayout.com and can continue to be used by other consumers.
IV. THE SERVICE AND PERFORMANCE OF THE CONTRACT
1. The Service Provider provides the Client with services related to the functionality of the floor area of premises. 1. Justalayout.com provides the Client with the "Justalayout" floor plan design and interior architecture service, within which the following Service categories are available to the Client with the following details:

2. Following the submission of the Service selected by the Client to Justalayout.com , in the automated message received, Justalayout.com informs the Client about the formation of the contract and that within 5 business days of the order, Justalayout.com will contact the Client through the contact details provided to discuss the details of the Service and further processes.
3. In the automated message sent to the Client following the submission of the order, the Client has the opportunity to complete Justalayout.com the questionnaire compiled by Justalayout.com to facilitate the performance of the Service.
4. Justalayout.com undertakes to contact the Client by phone within 5 business days of the order received from the Client to discuss the details of the Service and further processes. The purpose of the phone call is to help Justalayout.com facilitate the performance of Justalayout.com's Service by verifying and, where necessary, correcting the data provided by the Client to facilitate the preparation of the floor plan or blueprint, and to allow Justalayout.com and the Client to arrange an appointment for the purpose of having a person commissioned by Justalayout.com to survey the Client's residential property. For unbuilt or unfinished residential properties, the Client must provide the planning documentation of the residential property in Justalayout.com the format required by Justalayout.com (dwg and/or pdf).
5. If Justalayout.com and the Client have successfully arranged an appointment and Justalayout.com has informed the Client in writing, and the Client has fully fulfilled their payment obligation under the concluded contract, the person commissioned by Justalayout.com is obliged to appear at the address previously provided by the Client and confirmed during personal contact. In this case, Justalayout.com using the tool necessary for the performance of the Service under these GTC, shall accurately survey the interior spaces of the residential property subject to the Service without structural investigation. The Client accepts that the conduct of the personal survey is a precondition for the performance of the Service, as Justalayout.com can only properly perform the contract for the Client with accurate measurement data. The Client expressly accepts that if Justalayout.com the Service can be performed at a different rate based on the survey conducted by Justalayout.com, taking into account the tasks to be performed based on the survey, then the consideration for the Service shall be determined Justalayout.com based on the data measured by Justalayout.com, and in this case the Client shall have the right of withdrawal due to the new circumstances arising. Accordingly, the Client acknowledges that the order placed on the Service website is merely a reference and informational point, and the Service and the amount of consideration shall be determined Justalayout.com based on the data measured by Justalayout.com.
6. Justalayout.com Within 20 business days of the survey carried out by Justalayout.com, Justalayout.com is obliged to prepare and send the Client the first version of the blueprint or floor plan. Within 5 business days of the blueprint or floor plan being sent by Justalayout.com , the Client is entitled to request corrections and modifications, which Justalayout.com is obliged to take into account before preparing the final blueprint or floor plan. If the Client Justalayout.com does not make a substantive written (e-mail) modification proposal to the first version of the blueprint or floor plan prepared by Justalayout.com within the aforementioned 5 business days, then Justalayout.com the version sent by Justalayout.com shall be deemed accepted by the Client and may not be disputed subsequently. Accordingly, Justalayout.com becomes entitled to the consideration for the Service.
7. If the Client submits modification and correction proposals within the deadline, Justalayout.com is obliged to take them into account when preparing the blueprint or floor plan.
8. Justalayout.com is obliged to provide the Client with the final blueprint or floor plan in “pdf” format within 25 business days from the survey carried out by it, or within 10 business days from the submission of the modification and correction proposals made by the Client.
V. INFORMATION ON THE ESSENTIAL CHARACTERISTICS OF THE SERVICE
1. Justalayout.com The Client may obtain information about the Service and its essential conditions, properties and characteristics (e.g. fees, payment terms and deadlines) on the basis of the information published on the Service website.
VI. FEES PAYABLE FOR THE USE OF THE SERVICE AND METHOD OF PAYMENT
1. The Client is obliged to pay the service fee for the Service used Justalayout.com on the basis of an invoice/payment request issued by Justalayout.com in accordance with applicable law, within the deadline indicated therein – 5 (five) days – by transferring the amount to Justalayout.com the bank account maintained in Justalayout.com's name, or using the bank card payment option provided by Justalayout.com.
2. Justalayout.com is entitled to issue a payment request regarding the service fee payable for the Service and to send it to the Client after the Client has ordered the Service through the Service website and the contract has been concluded. The Client is obliged to pay the service fee indicated on the payment request, following which Justalayout.com carries out the physical survey of the floor plan specified by the Client. Upon performance of the Service by Justalayout.com , the accounting document issued on the basis of the payment request shall be sent to the Client.
3. Justalayout.com is obliged to indicate on its Service website the information on the terms of remuneration for the Service – in particular regarding the additional charge for delivery to out-of-town Clients. Regarding the terms of remuneration, Justalayout.com is entitled to make amendments, and must notify the Client 30 days in advance of such amendments through the website.
4. Justalayout.com processes personal data made available to it in accordance with EU Regulation 2016/679 (GDPR), the detailed rules of which are contained in the Privacy Notice available on the Service website.
VII. TERMINATION OF CONTRACT, WITHDRAWAL
1. The contract concluded between Justalayout.com and the Client under these GTC is concluded for a fixed term, which Justalayout.com is performed upon the delivery of the blueprint or floor plan prepared by Justalayout.com to the Client.
2. The Client, in accordance with Section IV/3. of these GTC, is entitled to withdraw from the contract within 14 days from the receipt of the automated message confirming the order sent to Justalayout.com – the moment of conclusion of the contract – without the obligation to provide a reason. In this case, the Client shall not be subject to any payment obligation. If performance has commenced, the Client loses their right of withdrawal, which the Client acknowledges by accepting these GTC.
3. The Justalayout.com contract concluded between Justalayout.com and the Client shall be terminated if the termination of the contract is initiated by Justalayout.com or the Client by means of a written or electronically sent declaration addressed to each other.
4. If the termination of the contract referred to in Section VII/3. of these GTC is initiated by the Client, the paid service fee shall be refunded to the Client under the following conditions:
- If, following the completion of the survey appointment to be performed by the person commissioned by Justalayout.com as designated by the Client, the contract is cancelled, then Justalayout.com shall only refund 50% of the fee paid by the Client for the Service.
5. In the event of termination of the contract, the provisions of the Privacy Notice shall apply to the storage and destruction of data generated during the legal relationship.
6. Justalayout.com informs the Client that in the event of withdrawal, Justalayout.com may prevent the Client from further using the digital content and the digital service, in particular by making the digital content and the digital service inaccessible to the Client.
7. In the event of withdrawal from the contract, the Client shall refrain from using the digital content or the digital service and from making these available to third parties.
VIII. LIABILITY
1. The information on the Service website has been placed in good faith by Justalayout.com , but they serve solely for informational purposes, and Justalayout.com accepts no liability for the accuracy or completeness of the information.Justalayout.com accepts no liability for the accuracy or completeness of the information.
2. Justalayout.com accepts no liability for any potential losses, damages, costs, or loss of profit that may arise for the Client from the use of the Service. The Client may use the website operated by Justalayout.com and the Service website solely at their own risk, and expressly accepts that Justalayout.com accepts no liability for material and non-material damages arising during use.
3. Justalayout.com excludes all liability for the conduct of Clients on the Service website. The Client is fully and exclusively responsible for their own conduct, and Justalayout.com in such cases fully cooperates with the acting authorities to detect infringements.
4. Justalayout.com excludes all liability arising from the fact that the Service website becomes accessible to the Client through additional connection points or links, or which lead to the pages of other service providers. Justalayout.comaccepts no liability for the data protection practices and other activities of these service providers.
5. Justalayout.com also accepts no liability for operational or content errors or deficiencies arising directly, indirectly, or accidentally when visiting the Service website, nor for any errors resulting from the Client providing incorrect data. With regard to liability issues, the Client accepts that they act in accordance with the provisions of applicable national laws when using the Service website.
6. The Client is responsible for keeping their access credentials confidential. If the Client becomes aware that an unauthorised third party may have gained access to the data provided during registration or is misusing them in any way, the Client is obliged to simultaneously notify Justalayout.com. Liability for damages arising from the failure to fulfil the above obligations rests solely with the Client.
7. Justalayout.com excludes all liability arising from the fact that the investment and construction work carried out on the property on the basis of the blueprint or floor plan provided to the Client has not been performed properly, in particular with regard to damages caused during the investment and construction work, as well as damages caused by materials incorporated into the property.
8. By accepting these GTC, the Client expressly declares that they have the appropriate authorisation with regard to the data, documents, photographs and any related data content made available to Justalayout.com. The Client expressly declares that they assume full liability for damages arising from the unlawful use of data, documents, photographs and any related data content made available to Justalayout.com. Justalayout.com Justalayout.com presumes the lawful use by the Client with regard to the data content made available by the Client.
IX. DATA PROCESSING
1. Justalayout.com Justalayout.com may process data for up to 5 years following the termination of the contract concluded with the Client, or until the expiry of the limitation period under the Civil Code or the end of enforcement of claims. Personal data made available to it is processed in accordance with EU Regulation 2016/679 (GDPR), the detailed rules of which are contained in the Privacy Notice on the Service website.
X. AMENDMENT OF THE GTC
1. Justalayout.com is entitled to unilaterally supplement or amend the provisions of these GTC, in particular in the event of the introduction of a new Service or the amendment of the conditions of existing Services. The Client shall publish the notice of the amendment to the GTC on the Service website or through the communication channel provided by the Client (e.g. email) 15 days before it enters into force. It is the Client's responsibility to become acquainted with the content of any amendment to the GTC and to obtain information about it on the Service website.
2. If Justalayout.com the contract for the Service between Justalayout.com and the Client was concluded prior to the amendment of the GTC, the provisions of the previous GTC shall apply to the contract.
3. All amendments to the GTC are made continuously available for download on the Service website.
XI. TRADEMARKS AND COPYRIGHTS
1. Pursuant to Section 1(1) of Act LXXVI of 1999 on Copyright (hereinafter: Copyright Act) and Section 1(1) of Act XI of 1997 on the Protection of Trademarks and Geographical Indications (hereinafter: Trademark Act), the Service provided by Justalayout.com and the graphic designs, trademarks, logos, and other information and materials appearing on the website it operates are Justalayout.com the exclusive property of Justalayout.com. These designations may not be used, copied, distributed or published in any way for revenue-generating purposes by the Client or other third parties without the prior written consent of Justalayout.com . Any material taken from the website and its database, even with the written consent of the rights holder, may only be used with reference to the website and the indication of the source.
2. By taking any content from the website, the recipient acknowledges that they are using the content in exchange for payment of 335 EURO + VAT per day, except for those holding a specific agreement or written permission to do so.
3. Justalayout.com The full and exclusive right of disposal over the blueprint or floor plan prepared under the contract between Justalayout.com and the Client, as well as the legally protected solutions implemented therein, shall vest in Justalayout.com under Act LXXVI of 1999 on Copyright, as it is an intellectual product of Justalayout.com .
4. By accepting these GTC, the Client acquires the right to use the blueprint or floor plan once for the purpose and use set out in this contract.
5. For the repeated use of the blueprint or floor plan or their parts, or for transferring or assigning them to others for consideration, the separate written consent of Justalayout.com or a written agreement between Justalayout.com and the Client is required. In the event of a breach, the Client shall be liable for damages to Justalayout.com.
6. Justalayout.com warrants that no third party has any right of use or other restrictive right over the blueprint or floor plan document it has prepared.
7. The Client acknowledges that the blueprint and/or floor plan is suitable for carrying out the necessary construction and/or renovation works, but does not qualify as a construction implementation plan. By accepting these GTC, the Client acknowledges that the construction works carried out on the basis of the blueprint and/or floor plan must be harmonised with local building regulations, and that the tasks relating to the feasibility and implementation of the blueprint and/or floor plan are the Client's obligation. By accepting these GTC, the Client acknowledges that Kinoki shall bear no liability for any disadvantages arising from bringing the blueprint and/or floor plan into compliance with local building regulations. The Client further declares that Justalayout.com the Client assumes and bears liability for any defects in construction work carried out with regard to the blueprint and/or floor plan handed over by Justalayout.com, as well as for construction work carried out after modification of the handed-over blueprint and/or floor plan.
8. If the Client breaches the provisions set out in these GTC, the Client shall bear the damages arising therefrom themselves, provided that the Justalayout.com's liability is excluded.

1. Complaint handling
1.1. Justalayout.com provides complaint handling for the Client regarding complaints related to the Service through the following contact details:

Justalayout.com Justalayout.com undertakes to investigate complaints received within 30 (thirty) days of receipt and to respond to the Client in writing.
If the Client disagrees with the outcome of the complaint handling, or the investigation of the complaint does not lead to a result, they are entitled to turn to the alternative dispute resolution forum competent for their place of residence.
The European Union online dispute resolution platform may also be used for the out-of-court settlement of consumer disputes, accessible at the following link:

Kinoki cooperates with the competent alternative dispute resolution forums in accordance with the applicable laws.
XIV. CONSUMER RIGHTS
1. Justalayout.com informs the Client that, in connection with the Service, the Client is entitled to the consumer rights under DIRECTIVE 2011/83/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL.
XV. FINAL PROVISIONS
1. Justalayout.com reserves all rights with respect to the Service, the related website, any part thereof and the content appearing on it, as well as with respect to the operation and distribution of the website. It is prohibited to download, electronically store, process or sell the content appearing on the website or any part thereof without the written consent of Justalayout.com. Justalayout.com Justalayout.com also reserves the right to permanently restrict the Client's access to the Service without prior warning or notice if the Client breaches the provisions of the GTC or uses the Service in an abusive manner.
2. Justalayout.com reserves the right to delete the data of Clients who, in its judgement, misuse the name, image, e-mail address, or other personal data or rights of any other person, in particular if, to its knowledge, the relevant Client name is protected by trademark or other type of protection, infringes the legitimate interests of another person, or may be considered as containing obscene or offensive words, racist, religious, national, ethnic, sexual orientation-disparaging or offensive content, or covert or overt advertising. 3. The Service is available on the website with the domain name www.justalayout.com, which operates in Hungary; it is also maintained here. Since the website can be visited from other countries, the Client expressly acknowledges that in the relationship between the Client and the governing law is Hungarian law. With regard to disputes arising from this contract, the Client and Justalayout.com submit to the jurisdiction of the national courts competent in consumer protection matters.
4. The Client acknowledges and accepts that Justalayout.com shall treat the data that comes into its possession as confidential, shall use it exclusively for the performance of the contract, and shall not disclose it to any third party in any form. By providing their personal data, the Client consents to Justalayout.com processing them in accordance with the Privacy Notice.
5. Justalayout.com is entitled to engage subcontractors and collaborators.
6. Justalayout.com Justalayout.com is a legal entity registered in Hungary; the rules of Hungarian law govern and apply to these GTC, regardless of any potential conflict of laws.
7. For any legal dispute related to these GTC or the Service, or to the services provided by Justalayout.com, regardless of any potential conflict of laws, Justalayout.com and the Client submit to the jurisdiction and competence of the national courts competent in consumer protection matters.
